According to a report from BET.com, Jussie’s Smollett’s criminal case isn’t over yet. Reported first by Variety, just one month after a judge in Illinois requested a special investigator look at the case, the star’s lawyer is now asking the judge to reverse the decision.
In a filing made on the 19th of July, Jussie Smollett, represented by Geragos and Geragos, asked for the court to vacate the June 21st, 2019 Order, and deny the petition to appoint a Special Prosecutor. Jussie’s lawyer said this new case is a “travesty of justice,” as well as the “deprivation” of the actor’s constitutionally granted rights.
Followers of the case know that Mr. Smollett claims he was the victim of a racist and homophobic hate crime on the 29th of January. Later on, it was discovered by the Chicago Police Department that the actor allegedly had made the entire thing up.
The issue gets even more messy as Tina Glandin and Mark Geragos are facing a federal defamation lawsuit from Ola and Abel Osundairo. These are the two men that Jussie paid to attack him one evening when he was out to get a Subway sandwich.

Following the dropped charges against the actor, implemented by the District Attorney of Chicago, Kim Foxx, the City of Chicago is suing the actor for the costs of conducting the investigation as well.
When it was first revealed that the actor supposedly orchestrated the crime against himself, the mayor of Chicago as well as the police superintendent, and the police commander, came out during the press conference to say the dropped charges were an example of the “white-washing” of justice.
Since then, Jussie has been removed from the cast of Empire. Sources close to the set previously stated writers were figuring out a way to include the actor back into the storyline, however, Lee Daniels, the creator of the series came out later and dispelled rumors of Jussie’s continued involvement.
